Is it time to challenge

Post by _mocnarf »

Is it time to challenge the laws prohibiting charities from exercising political speak.
Consider the arguments put forth by this article:

Maybe some of our legal eagles here on this board can enlighten me as to why this law has not been challenge by virtue of the Second Amendment prohibitions/protections.

What are you aiming at? ;)

people who use the term liberal as a perjorative are very likely to ignore any and all laws or regulations which in their own twisted mind were put in place by liberal activist which is code for "I do not know how to debate a point so since I disagree with you but can not articulate my disagreement you are a liberal activist"

Ok..... would you like to take a stab at the question? "Is it time to challenge the laws prohibiting charities from exercising political speak."

Well, I'm a libertarian so my views are a little skewed.

Nobody, in my view, should have a tax exemption. If we got rid of tax exemptions there'd be much lower tax rates and less incentive to cheat.

But, what you're pointing to is a rule which prohibits churches or charities from having as their principal object a political objective. If a church or charity crosses the 50% line, they lose their tax exemption. It has happened recently.

But losing their tax exemption has nothing to do with political speech. They can speak all they want with or without a tax exemption under rights guaranteed by the First Amendment.

Mocnarf. What kind of challenge? That it is unconstitutional for congress to exempt churches from paying taxes? Or that it is unconstitutional for congress to place conditions on tax exemption?

Churches should not be allowed in the political arena; lest we forget 2000years of how bad it is for church and politics to mix.
