This seems to be a slight stretch of the "zealous representation" principle of defense attorneys. But I guess if you're facing the death penalty, you leave no stone unturned.
Thanks, skippy. I guess not. But doesn't it hurt the attorneys' reputation? They've already got the Boner of the Day award on X96. That's probably the only award they will ever get.
Not necessarily - if they ultimately win an acquittal, it's that final result that would be remembered. Besides, pretrial motions are a lot like making spaghetti - you throw it against the wall and see what sticks. And if you don't have a lot to work with, you need to be a little creative. If I were the defense attorney on the case, I couldn't care less what a morning radio program said about me - it's about the client and keeping him alive.
And don't doubt for a second that both prosecution and defense will keep in mind the jurors' suspected religious beliefs in trying the case. Whatever it takes to win, eh?
