It's not a direct threat. It's innuendo that could be read as metaphorical, but given the context of his previous behavior and apparent instability should be treated seriously.
(That post isn't illegal or anything, so the suggesting that it existing on the board is a violation of the law is a bit much.)

Scottie, Harmony, and I all feel that Jersey Girl should not be banned. If you look at the context of both threads, it is obvious that Jersey Girl's reaction was one of panic because she was frightened for herself and others. Her "15 minute Jihad", as Shades as referred to it, was done in a moment of panic and desperation because she felt that the Moderating team was not taking Darrick's threats seriously. I was not on the board at the time, and no one had communicated to her that Darrick had been suspended. Had she known that, she would not have even filed the very mild inquiry that she filed (which Dream Host promptly dismissed with no action).
Cam mentioned earlier in the thread that it is extremely unlikely that Darrick has the economical resources to be a real threat to anyone on this board. However, we have no idea what Darrick is capable of. He is like a ticking time bomb. It is solid fact that Darrick physically threatened Dan Peterson, Dan's family, and several of Dan's friends and colleagues with physical bodily harm, and there is a police record on file indicating that. Jersey Girl knew all of this. This was factored into her doing what she did.
My feeling is that if we are going to make allowances for others, and attempt to work with them...like we did Joseph and SWG, we should offer Jersey Girl the same courtesty.
Shades refuses to "make the first move" and email Jersey Girl, but I have given Jersey Girl Shades email address with Shades' permission, and I hope that they can talk privately, and, at the very least, come to an understanding of true motivations.
Whether, at the end of that conversation, Jersey Girl will return to the board, I don't know, but at least she and Shades will have had an opportunity to communicate one on one.
That is where things stand at the present time.

Just to clarify something, Jersey Girl could have let Shades and the mods handle this. The facts that she threatened to contact Dreamhost and did, makes your supposed clarification nothing more than your opinion as you use "inquiry" to dilute what happened.
I vote let the ban stand and used as a metric for rogue cowboys/girls who feel the need to disrupt a free discussion board.

Actually, Ms. Jack used the word, "inquiry", because that is exactly what it was that Jersey Girl sent. There are different forms used when filing grievances with Dream Host, and "inquiry" is the most benign.

Shades and I presently favor banning. Liz, Harm, and Scottie do not, though Scottie's reasoning is a bit distinct from Liz to some extent and Harm to a great extent. I don't think it is useful to talk about why we think what we do without opening up the full discussion, but that is more problematic in of itself that others might appreciate.

"This happened: I don't know if this is a violation of of the board's contract with you, but please check it out and respond" I think should be read as more than entirely benign. Especially when you consider that she threatened to take legal action over it.

I'm ambivalent regarding this whole matter. Bring her back, leave her banned, Jersey Girl's fate doesn't keep me up at night. Derrick did make threatening comments to people on this board, but I'd hesitate to say that Jersey Girl was cowering in fear because of those comments. A more accurate characterization would be hyper-vigilance; judge, jury, and executioner. I felt as though she was being a bit of a show-off.
To another point. Jersey Girl did *not* state that she was simply seeking clarification from DreamHost regarding policy. I have PMs from Jersey Girl that detail a different story with different motives.
I've said this before, I'll say it again - Jersey Girl knew she what she was getting into, she knew that she could get banned, and she kicked the hornet's nest anyways.
The stupidest thing about this whole situation is that it could have been avoided had the mods just announced that Derrick was suspended pending discussion of a perma-ban. This whole situation could have been avoided if that had happened, and Jersey Girl could still be here nannying the board.
