The issue, seems to me, is the permanent banning decision. I'm not sure if anyone has actually argued that Jersey Girl was in the right and should face nothing, rather that the permanent banning is too harsh. It is somewhat disconcerting that past experiences with posters being threatened with lawsuits were allowed the free air of speech on the board even for extended periods, but that the flimsiest of threats that have no substance or basis in reality are treated with ultimate concern when it comes mods or shades.
EA has made the, what I consider, reasonable point that let's get real here there was no real threat to Jersey Girl even though Derrick was a loose cannon and there was plenty that Jersey Girl could do to protect herself (i.e call police etc..) that banning Derrick wouldn't have changed at all. One could even argue that banning Derrick could have escalated his motive. But that same consideration has to be given to Jersey Girl. I know as much as the next guy that some pretty silly lawsuits get filed and the fear of that is real, it is what I do for a living (not filing shady suits but real ones). But, there is also just downright ridiculousness and that is what Jersey Girl having any kind of plausible claim to file a suit against the board is, ridiculous. She would certainly be laughed out my office and I believe she would laughed out a lawyer's office found in an old strip mall. Just like Derrick's banning doesn't solve any threats - she can just as easily sue the board while banned as not. In all probability the fear to Shades would less if she continued to post. The act of not banning her would provide behavior that would essentially waive any claim she could make even under these flimsiest of facts. So we should get real on both fronts.
There is no logical 2+2=4 connection in correspondence with what happened and a permanent ban, that's just dramatic flair.
