CA gay marriage ruling ....

AP reporting that the CA Supreme Court has upheld Prop. 8 BUT recognizes the 18,000+ gay marriages that occurred pre-Prop. 8.

Equality under the law loses this round, but it's not out for good. Expect to see gay marriage in California within five years.

I see a silver lining. No matter what folks in CA think, or what the law says about future marriages, the fact remains that CA law NOW recognizes the MARRIAGE of 18,000+ gay couples! The CA state constitution is extremely easy to amend, or unamend, so we'll see an anti-Prop. 8 referendum each election cycle. I agree with you that Prop. 8's days are numbered.

I'd like to take this opportunity to complain about California's initiative system. Prop 13 screwed us in the ass so hard that budget sanity is not in the foreseeable future. And why even have a constitution if it can be amended by a simple majority?

Sad, but not unexpected.

Prop 8 will go away one day. SSM proponents, who are personally invested in the fight, will not give up because of yet another speed bump along the road.

The LDS church and movement conservatives will one day realize that throwing money and effort to stem the tide and kick against the pricks is an exercise in futility. It's one thing to get people geared up to donate massive amounts of time, money and energy during 1 election cycle. It is another thing altogether to convince them to continue to do it year after year.
Reality has a known anti-Mormon bias.

Some pro-gay-marriage commentators are saying that this is the ideal ruling for the marriage equality movement: it doesn't make the majority that voted for Prop 8 feel like they're being repressed, but the 18,000 marriages that are still valid will give empirical proof that none of the boogeymen that the Yes on 8 fearmongers foretold will come to pass as a result of gay marriage. That's good political optics, but I just can't get comfortable with the idea that constitutional rights can be rescinded by simple majorities.

But those 18,000+ marriages will show CA voters that this really is not the big deal portrayed by Mormons and others, which will only serve to hasten the death of Prop. H8te.

SAN FRANCISCO (AP) - The California Supreme Court upheld a voter-approved ban on same-sex marriage Tuesday, but it also decided that the estimated 18,000 gay couples who tied the knot before the law took effect will stay wed.

Demonstrators outside the court yelled "shame on you!"

The 6-1 decision written by Chief Justice Ron George rejected an argument by gay rights activists that the ban revised the California Constitution's equal protection clause to such a dramatic degree that it first needed the Legislature's approval.
