Distinguishing Marriage from an Adulterous Affair

What attributes of a relationship between a man and a woman that involves sexual relations between them distinguishes the relationship as a marriage rather than just an adulterous affair?

I was thinking that the distinction for apologists seems to be solely that there was a formal ceremony (even if it was done in secret with the "bride" dressed in man's clothing). I guess Fanny Alger probably doesn't count as a wife, by this definition.

1. Marriage=first wife/husband. Adulterous affair=subsequent wives/women/husbands/men while still married to first wife/husband.

2. Marriage=legal security (ie, must be dissolved by legal decree). Adulterous affair=not legally binding.

3. Marriage=commitment. Adulterous affair=not committed enough to make it legal.

It is easy to tell the difference. If your name is William Smith or John Bennett it is an adulterous affair but if your name is Joseph Smith it is a marriage. As BC likes to point out about Joseph Smith, we have no evidence of children from the affairs of either John Bennett of William Smith, so they were also obviously not about sex.
