Gorsuch is a best case scenario Trump Supreme Court pick. Probably deliberately so. He almost certainly would not be replaced with someone better.

Trump is going to have to respect the man disagreeing with him. I just wonder if he can really manage it.

The Trump admin is not going to appeal to he injunction to the Supreme Court. That's a good thing, I suppose, but it's hard to take seriously Trump and his legal team's argument that the travel ban is based on an immediate national security risk if they don't appeal to the Supreme Court.

Yes, NBC is reporting the administration is planning to defend the executive order back in the District Court. Meanwhile, travel/immigration ban 2.0 is being drafted and (hopefully) properly vetted.

It's not dead yet. A judge in the 9th Circuit has requested a vote on whether the motion to stay should be heard by an en banc panel. http://cdn.ca9.uscourts.gov/datastore/g ... 0Order.pdf

The parties have been asked to submit briefs. All active 9thCir judges will vote. If they vote for a rehearing, the motion to stay will be reheard by a panel of 11 judges that includes the chief judge.
