I'm going to respond to the OP in a little more detail.

If either of you becomes infected with COVID-19 as a result of this individual not wearing a mask, you may have a valid claim for damages to recoup medical bills and other damages. It is also possible that there are certain actions you could take or not take that would affect any such claim. That will depend on Colorado and maybe some federal law.

I don't know the answer to your questions, other than you are not crazy to be thinking about, if the worst should happen, whether someone else is legally responsible for the harm. Personal injury law is a specialty -- one that I haven't touched since my second year of practice. When I am asked questions like yours, I refer them to a very competent personal injury lawyer that I know.

I'm happy to talk about law, answer questions to the extent I can, and help educate folks on the legal system. But a direct request for legal advice is a whole different animal, and triggers my professional, ethical responsibilities. I am not licensed in Colorado. I know nothing about Colorado personal injury law. If the same series of events had happened to me, I would call a friend with decades of experience litigating personal injury cases and ask him what he thought. I owe you the same advice I would give to myself.

No. But there's a dead deer about to blow up on the side of the road a couple of blocks away. Maybe I could work something out but I'd probably get arrested for poaching it's head.
