He didn't "fire" the taser nor [i]could[/i] he because it was already dispensed. The only chance of using the taser would be at point blank range but he was several yards away and running away from him. The cop knew this before gunning him down. There was no credible threat to the cop, let alone to his life. To argue otherwise is disingenuous.

The laws need to be changed the same way they were changed to prevent cops from pursuing cars in high speed chases. This guy was no threat to anyone. The interview with his attorney said his investigation into the matter revealed it was dispensed and that the flare you see when Brooks pulled the trigger is what you see when doing a "dry tase" which is when you press up against the body and point blank range.

Brooks was tased twice before running off, but there were two tasers involved so who knows. In any event, running off with a taser isn't a crime punishable by death.
