I'm a little confused about the duct tape, which I think is more important than the chloroform in premeditation. The chloroform could have been intended to sedate her while Casey partied. The duct tape, if wound around the mouth and nose as I keep hearing, could have had only one purpose: to kill.
So was the duct tape actually found wound around the skull three times, or was it over to the side and they concluded it was wound around the head due to the attached hair mat?
My thoughts about the duct tape are that if the duct tape was actually still WOUND AROUND the skull, then there is no way Kronk lifting it slightly through the eye socket could have managed to make the duct tape be wound around the skull. If the duct tape was simply over to the side, attached to a hair mat, then it could have been somewhere else and animals or Kronk moved it and it got stuck on the hair mat.

I think I got the answer to my question. (Jersey Girl will be able to tell that I didn't watch the trial as closely as she did by my ignorant question. ;)

I have to retract my previous comments. I think the duct tape shows intent to kill, not just sedate. The only way that duct tape was wound around that skull is if a human being did that. There is no way George was involved in it. So the only two people left are Casey and Kronk. I do not believe Kronk wound duct tape around the skull. There was no reason to do so. That leaves Casey. I read Jersey Girl's theory that she was attempting to make it look like a murder/kidnapping but I reject that. She didn't report Casey missing. If she wanted to pretend that someone else killed her, she would have.
I am now definitely willing to vote for first degree.

Earlier Thursday, the trial focused on the Caylee’s remains found in the wood near Antony’s house in December 2008. The graphic photos of the two year old girl’s remain were shown in the court, after seeing which Casey’s lowered her head and cried. Even the jurors were shocked after seeing the photos. Some of the jurors even found it difficult to watch the photos and one of them almost cried.
There was a duct tape wound round the Caylee’s skull and small white pearly teeth were shown. The photo also showed a black plastic bag, an off-white canvas bag, a red color plastic Disney bag, a blanket, pair of shorts, and some clothing leftovers.

I just finished watching the videos of today's proceedings however, wftv.com only has videos posted up until just before Baez refers to Ashton as "laughing guy" at which point they were told by the judge to approach the bench. When Baez mentioned at the beginning of the day that Ashton needed to refrain from smirking and other types of disrespectful facial gestures, Judge Perry admitted that he couldn't see Ashton because a screen or monitor was blocking his view.
Let me say here that Baez is right. Ashton has been making facial gestures throughout the Defense presentations and today (after being warned by Perry) he was doing it AGAIN and that is when Baez made the "laughing guy" remark. He was presenting to the jury, glanced over at Ashton laughing at him and made the remark.
Ashton is a skilled attorney. His facial gestures throughout the trial are unprofessional and immature and Perry has never witnessed this because his view of Ashton has been blocked the entire time. Apparently after this laughing event took place, Judge Perry took them both into chambers to watch a video of the event and made them both apologize to the court.
That last part I haven't seen because wftv doesn't have all the videos posted as of this writing.
I will comment more later with regard to what you've mentioned.

Hello, I have to say for the most part I'm really impressed with your knowledge on this case, and I enjoyed reading a breakdown of the evidence, without all the emotions. Your blog on Dr. Spitz was a good read on the skull examination, I missed that one and did not hear everything. I also like how you asked over and over where was the body between June 16th and June 24th, because there was no smell.
On the issue of the duct tape being found wrapped around her head, I have been asking the same question for weeks now. I know the prosecution showed a video with the duct tape superimposed over her head, but was this how she was really found. I know it was attached to the hair mat, which was a few strands of hair. I do not think it was found wrapped around her head, because the prosecution would not have had to show that video, they could have just simply showed the pictures from the crime scene. I have asked and read about it, and I'm not convinced it was wrapped around the skull, and it was just
assumed it had been placed on her face, because it was so close being attached the hair mat. Still trying to get a solid answer on that though.
I have to say though towards the end of the blogs I was a little disappointed, it just all became emotional. I think a lot of people should read this blog though, very informative.

Thanks for explaining about the hair mat and duct tape, with all the testimonies and blogs, it was a little confusing.
I was glad Baez brought up the smell issue today, and really broke it down.
Question still remains " Where was Caylee's body, during that time?" if she was in the backyard that entire time wouldn't they have smelt her?

Neither the prosecution nor the defense has attempted to account for where the body might have been during that time. Keep in mind that the only job for the defense is to raise reasonable doubt.
I will likely do a post tomorrow about the closing remarks. It's been a long day and I just don't feel up to it right now.

Wondering if anyone else listened to all the closing arguments, rebuttal and jury instructions. I'm going through the jury instructions for the second time and will likely have to do it a third. The instructions regarding the various verdicts are very explicit. I'm going to hypothetically put myself on the jury and see what I verdict I would agree with.
