This is the start of 'reading your rights' when the cops and legal types start questioning. Then the first thing they ask is 'do you understand these rights'? This supposes you give up the right to remain silent, doesn't it? They want and demand a verbal response.

Kind of dumb of them and a catch 22 for the person who chooses to remain fully silent.
Before you criticize someone, walk a mile in their shoes. That way when you do criticize them you'll be a mile away and you'll have their shoes.
