The ONLY reason that the 1988 confirmation occurred was because the nomination was in 1987 and a 7 month delay from nomination to confirmation occurred.
Cruz is correct that standard practice for 80 years is to NOT "either way" like he said in the video, to nominate and confirm someone during an Election year.

Thus, Cruz did not lie.

Further, if you all actually watch the video, the audience wasn't booing "facts" they were booing the moderator's waffle attempting to confuse.

CRUZ: "We have 80 years of precedent of not confirming Supreme Court justices in an election year."

The moderator knew this wasn't true and he didn't let him get away with it...

DICKERSON: Just can I -- I'm sorry to interrupt, were any appointed in an election year or is that just there were 80 years...

Cruz doubles down on his lie....

CRUZ: Eighty years of not confirming. For example, LBJ nominated Abe Fortas. Fortas did not get confirmed. He was defeated.

DICKERSON: But Kennedy was confirmed in '88.

He then triples down on his lie...

CRUZ: No, Kennedy was confirmed in '87...

DICKERSON: He was appointed in '87.

CRUZ: He was appointed in...

DICKERSON: ... confirmed in '88. That's the question, is it appointing or confirming, what's the difference?

CRUZ: In this case it's both. But if I could answer the question...

DICKERSON: Sorry, I just want to get the facts straight for the audience. But I apologize.


So he lied and then repeated it twice when the moderator gave him ample opportunity to back away or clarify in a way that would help him save face. It is also worth pointing out that Kennedy was appointed on Nov 30, 1987 and confirmed in February 3, 1988, which was only a three month gap, not an entire year as Cruz made it seem.

I get what you are saying. I can't help noticing that Ted Cruz's attempts to smile all look like contemptuous, cynical sneers, like he is supremely confident of his own intellectual and moral superiority over anyone else--especially anyone who has the unmitigated gall to disagree with him about anything or question his judgment.
