You are the one that raised the distinction as an issue by claiming that the 9th Amendment was part of the Bill of Rights. Maybe you should ask yourself why you thought the distrinction was important last night. Whatever it was, it was wrong.

And now you've done it again, for heavens sake. The first ten amendments were not "in the Constitution." They are, like their titles say, amendments to the Constitution. The Constitution was adopted in 1787 and ratified in 1788. The first ten amendments known as the Bill of Rights were approved by Congress in 1789 and ratified in 1791.

This gets at the underlying concern with folks who like to talk like originalists but for whom the Constitution is detached from history. Maybe they've read it, probably not. But they almost never have a reasonable understanding of the debates and varied views that molded and shaped the process as well as the final documents. To Cultellus the idea he has about how things ought to be is too precious to be bothered by history or I guess even the content of the documents. Whatever.

Here's a good reminder that leaving the issue of abortion to the states does not mean that the state legislature's have unlimited discretion. States have constitutions, too, some of which have been interpreted to protect abortion rights. https://www.washingtonpost.com/nation/2 ... tion=alert
