Huh? I have a tibial plateau fracture in my knee. It is one of the most painful injuries I have ever had. I had surgery three weeks ago. I will be unable to walk for a total of 9 weeks. I am happy that my wife is so damn patient and helpful. I am happy that my surgeons and specialists were so great. I am happy with the physical therapists and routines. I can bend my knee in a range of -10 to +60 today. I am happy about that.Kishkumen wrote: ↑Fri Sep 02, 2022 2:44 pmSo which part are you unhappy about?Binger wrote: ↑Thu Sep 01, 2022 1:34 pmBut, it was Hillary and people were crying to throw her in jail but she was not thrown in jail. Why? Did I say something about my happiness that prompted you to ask?

Very well put.honorentheos wrote: ↑Thu Sep 01, 2022 1:37 pmAnd that's the great tragedy of it all. Easily manipulated "individualists" frustrated by a system that doesn't just let them do whatever they want when they want are the prime targets for forming into a mindless mob of angry know-nothings out to restore the dignity of the individual by imposing an authoritarian against the rule of law. Kids storming city hall for the right to drag Main Street.

Just some data to throw into the hopper: this week, Trump appointed judges ruled that Lindsay Graham had to Comply with the January 6th committee’s subpoena and dismissed Carter Page’s lawsuit against the government and several individuals based on the FISA surveillance conduct as part of Crossfire Hurricane.
I’m sure Trump’s lawyers judge shopped for a judge they thought would favor Trump. That doesn’t mean she’s in Trump’s pocket.

So, not dismissed and Trump wins? Or, am I conflating cases?Res Ipsa wrote: ↑Wed Aug 31, 2022 4:15 amI’ve now read the response brief of the DOJ and the proposed amicus brief. Something I learned — the judge doesn’t have subject matter jurisdiction, which is fatal to Trump’s case. The Presidential Records Act vests exclusive jurisdiction in the federal court for the District of Columbia.
It’s unlikely any Florida District judge is familiar with the PRA because lawyers generally avoid filing suits before judges who lack jurisdiction to hear the case. In my experience, your typical federal judge would read the riot act to Trump’s lawyers for concealing that significant problem. Lawyers have a duty of candor toward the judge, and bringing a lawsuit under a statute that says the court has no jurisdiction without calling the judge’s attention to the issue and presenting an argument that addresses the jurisdictional problem is not exactly being candid with the judge.
Subject matter jurisdiction is first-year law student stuff. Trump gets to file a reply tomorrow, but the jurisdictional problem doesn’t look fixable to me. I expect the judge to dismiss the case.

Yep, she granted the motion. I started a new thread on it, in which I explain that I found her argument for equitable jurisdictions persuasive. I think the government outlawed a trump in terms of the briefing, but that doesn’t mean the government was right. Unless I’m missing something, the ruling doesn’t give any heartburn.Binger wrote: ↑Mon Sep 05, 2022 4:25 pmSo, not dismissed and Trump wins?
