Jesus was condemned by Man's 'court'. Yes, Laban could have been disposed of in numerous ways, but that doesn't test Nephi's faith/obedience, now does it? It wasn't Nephi's conscience that made him hesitate, it was doubt. Jesus didn't really want to drink from the bitter cup, but He did so.

It was a test of obedience and faith. What better way to do that than with something one is uncomfortable with? It wouldn't have been much of a trial if the Lord had told Nephi to throw some magic dirt on Laban, which would have made him disappear (unbeknownst to Nephi).

On your own...I suppose should be the disclaimer. Remember, that command came from G-d. Why do you suppose He must adhere to it Himself? It wasn't meant for Him.
