The LDS Church scored a win with the Arizona Court of Appeals in being able to keep quiet about ongoing child abuse so that the abuse can continue unfettered by law enforcement and the Church can be free of legal consequences. Spokesperson Elder Dylann Roof of the First Quorum of Kirton McConkie was quite pleased the Appeals judges "actually bought what we were shoveling. Having a bunch of Republicans in Arizona really pays off."

TL/DR To waive the priest-penitent privilege, the penitent must disclose something about the communication. Disclosing conduct that was the subject of the communication is not sufficient to waive the privilege. Because the privilege belongs to the penitent and not the church, internal disclosure by the church as part of a disciplinary process cannot waive the privilege.
