If a violent act is driven by bigotry they should be prosecuted to a higher extent than a typical juvenile vandal spraypainting gang signs on someones house.

I firmly disagree with your interpretation of the text, as we have discussed before.
Intent is already recognized in legal proceedings. For example, there is a difference between involuntary manslaughter and 1st degree murder. There is a good reason for that. The outcome may be the same, but the intent is not. Hence the difference.

I don't agree to that extent. Why don't we just set one standard for the crime? Who cares why they did it? Remove their thumbs so they can't use a spray can. That'll fix 'em.

It's possible to operate a spray can without a thumb. I've seen a guy do it.
