Linking to an image hosted on one site from another site is called "hotlinking." Although most message boards do require hotlinking to post images, you should never, ever hotlink an image hosted on someone else's site. Well "Joseph" there are thousands of message boards out there that do allow "hotlinking" and they haven't been shut down. There are boards much bigger and busier than this with thousands of pictures hotlinked each week -- but they aren't shut down.

Please read the exceptions to the ACT. Please read the case law. There is absolutely NO chance of ANY copyright lawsuit proceeding against this board. This board is protected from copyright infringement by Section 107 (1), (2) and (4).
However, Shades could civilly go after any person who sends a takedown notice. I offer my services to Shades pro bono if he should decide to do so.

In the meantime, please ban Joseph and reinstate the IMAGES.

Add in this site features ADVERTISING... and you have more of a problem.
Many will not object to your posting a photo. Those who do will shut this place down in a heartbeat without warning - after filing a legal action against the owners, ISP and every advertisor they see on the site in the banner ads that show up.
Joseph, the fact that this board is non-commercial is a complete defense that bars a copyright lawsuit from going forward. I have provided several cases and the law is well established. Neither of those two apply to mormondiscussions.com. Joseph it's clear that you really don't have a firm grasp of the law in this area.

The fact most of you know this is a contentious subject you can kiss 'good faith' or mistake goodbye.
Two items, Joseph. First, good faith is not one of the criteria under Section 107 that the courts will look at. Second, good faith doesn't mean a "contentious subject", but whether or not there was a good faith belief that the copyrighted material was subect to the exceptions set forth in Section 107. Again Joseph, please go back and educate yourself in this area of the law. It's painfully clear you do have a grasp of even the basics.

Good luck in getting that one to fly. Copyright infringement is heard in Federal Court. Registered images used without permission that are not clearly in Fair Use territory get litigated - in Federal Court. One great benefit of registration of photos is that the copyright owner is entitled to legal fees.
In the cases I cited, federal courts consistently bar copyright infringement cases if it fits under one of the exception of Section 107. Mormondiscussions.com has THREE complete defenses to any copyright infringement case (Section 107 (1), (2), (4)).
Again Joseph, anyone stupid enough to actually attempt to file a lawsuit against this board would find their lawsuit being immediately dismissed for failure to state a claim under which relief can be granted. This board is protected from a copyright lawsuit because it is non-commercial in nature, there is no negative effect on the market of any copyrighted material posted here and any copyrighted photos posted here are not duplicate copies in size and/or resolution.

The above case you cite involved a photo that was used without permission on a commercial website of a "Major U.S. media company". Joseph, mormondiscussion is a non-commercial website.
