SANFORD -- After five weeks of trial and 56 witnesses, few legal observers believed prosecutors came close to proving Sanford neighborhood watchman George Zimmerman committed second-degree murder when he shot and killed Trayvon Martin in February 2012.

So for many legal analysts, it was no surprise that jurors rejected even a lesser “compromise” verdict of manslaughter, acquitting Zimmerman outright of all criminal charges and deciding he acted in a reasonable way to protect his own life.

The acquittal was a stinging blow for prosecutors and their decision to file the second-degree murder charge against Zimmerman, who was not initially arrested by Sanford police after claiming self-defense. And it was a resounding embrace of the defense’s strategy during closing arguments not just to establish that prosecutors hadn’t proven Zimmerman guilty, but also to show he was “absolutely” innocent.

“Justifiable use of force is one of the most difficult areas of the law,” State Attorney Angela Corey acknowledged Saturday after Zimmerman’s acquittal. “Make no mistake, Trayvon Martin had every right to be on the premises as did George Zimmerman ... that’s what makes this case unique.”

Zimmerman defense attorney Don West Zimmerman defense attorney called the prosecution’s case a “disgrace.”

“We proved that George Zimmerman was not guilty,” he said.

Jude M. Faccidomo, the former president of Miami’s Florida Association of Criminal Defense Lawyers said the jury clearly believed in the right to self-defense: “Especially when cases are so gray, like this one was, self-defense really resonates because people can associate with being afraid.”

And while some also have questioned the state attorney’s office acceptance of a mostly white jury, a more diverse panel would have returned the same verdict, lawyers who have watched the case believe.

“After seeing the quality of the evidence presented by the state, the diversity of the jury really didn’t matter in the end,” said Larry Handfield, a prominent African American Miami criminal defense lawyer. “But it would have helped the community in giving more credibility to the decision to acquit Zimmerman.”

By now, the basic outline of the confrontation between the 29-year-old volunteer watch coordinator and the 17-year-old Miami Gardens student have become familiar through wall-to-wall television coverage and thousands of news stories.

Prosecutors said Zimmerman “profiled” Trayvon, who was returning from a nearby convenience store and was walking through the gated Retreat at Twin Lakes neighborhood where he was staying with his father.

Zimmerman called a non-emergency police number to report Trayvon as “suspicious.” A violent struggle followed on rain-slicked grass and a concrete walkway. During the confrontation, Zimmerman shot and killed Trayvon at point-blank range.

A look at the evidence shows why the jury rejected the state’s case. For prosecutors intent on proving the more serious charge, proving the “ill-will,” “hatred” or “spite” needed to convict on second-degree murder hinged on painting Zimmerman as a frustrated, would-be cop fed up with intruders in his gated Sanford community.

Zimmerman’s prosecution was made tougher under Florida’s 2005 Stand Your Ground law, which eliminated a citizen’s “duty to retreat” before using lethal force in the face of a deadly threat — an instruction given to jurors on Friday.

And the state’s case was filled with blunders, legal experts say.

Many of the witnesses called by the state seemed to benefit the defense, including one neighbor, John Good, who claimed he saw Trayvon pin Zimmerman to the ground. Another witness, Sanford Police officer Tim Smith, told jurors that Zimmerman, just after the shooting, claimed he was yelling for help to no avail. Both pieces of testimony seemed to bolster the defense’s version of the encounter.

Prosecutors also called the lead Sanford police investigators, using them to introduce each of Zimmerman’s videotaped statements and a walk-through of the crime scene Zimmerman did with police a day after Trayvon’s death.

During one of the statements, lead Detective Chris Serino seemed skeptical when Zimmerman insisted he never “followed” Trayvon. While there were some inconsistencies between his accounts of what happened, they seemed fairly small, court observers said. And defense attorneys got Serino to agree during testimony that it’s normal for stories to vary slightly with each re-telling.

Legal observers noted that playing the videos in court eliminated the need for Zimmerman himself to take the stand — a tactic that may have helped the defense by allowing Zimmerman’s voice to be heard in court without risk of cross-examination.

This has now been shown, and has been known for sometime, to be erroneous.

The only winners are ...Drudge for turning this into a national story, and treating us like sports spectators, everyone gets to choose sides and watch the events unfold on TV.

Drudge had nothing to do with it. This only became a national story when the usual race hustlers and the Obama Justice Department descended on Sanford, Florida and begin their community organizing-style rabble rousing and incendiary demagoguery (ending in the Black Panthers calling for a posse to hunt down and lynch George Zimmerman).

The intellectual and moral vacuity of the Left was on parade in this sorry episode in a very striking and clarifying way.

Lessons learned by the average American low-information citizen? Probably nil.

Nothing of the kind happened. The entire riot scenario came from the social networking world and from the usual suspects in the political race industry.

The United States Justice Department and the Attorney General taking an open side in a trail that had not yet even gone to court, engaging in public racial rabble-rousing, and poisoning the well of a local criminal trial.

No such claim exists as you state it. Do you mean The Bell Curve? This has been settled empirical social science for generations. The Bell Curve makes no such assertion save what decades of social science data demonstrate conclusively for all racial groups: average IQ differences relative to other groups.

The empirical data shows as well that Jews and Asians, as a group, present average IQ scores above those of whites, as a group. Its called a "bell curve" for a reason.

I didn't think it would be long before all the Creatures From the Left Lagoon poured out of their lairs now that their sacrificial lamb escaped their well-sharpened racial guillotine.

By the way, Dr. Thomas Sowell has always admitted that this empirical evidence exists and is solid, but as long disagreed with Murrey et al about the fundamental basis of those IQ differences. Thomas leans strongly toward a cultural basis of any salient average IQ differences, while Murray et al take a more reductionist, genetic view.

Unsurprisingly, I side with Sowell on this, and think that Murray and others within traditional academic sociology place exaggerated emphasis of genetic/biological factors. Murray himself has been clear that genetics, psychology, and environment (nature/nurture) play complex, interpenetrating roles in generating teh general cognitive patterns that are measured in IQ tests, but believes that genetics is dominant.

I tend to think that culture, family dynamics, and intrapsychological dynamics play a much larger role than the reductionist template allows.

The Bell Curve explicitly argues that IQ is a valid and reliable measure of intelligence, that racial groups have significant disparities in IQ, that IQ is largely heritable, and therefore that racial differences in intelligence are significantly a consequence of genetics. I thought you read it?

You refer to its conclusions as settled empirical social science, despite denying that psychology and therefore psychometrics even is a science, while not knowing anything about the state of that field. Maybe while your busy quoting Thomas Sowell on race and IQ in one instance, you can read what he has to say about the subject in another. Given that the APA's taskforce analysis of the meta-data concluded there was no support for this hypothesis, I think we can take your assertions on what the science says, science that you don't even agree is science, as about on par with your views on the environmental impact of oil spills.

The race riot predictions were coming from both sides. Lots of Zimmerman supporters predicting riots, but also a lot of Trayvon supporters threatening to riot if Zimerman was acquitted.

A few? The social networks are flooded with calls to riot and kill Zimmerman. Can those be ignored or are they legitimate? You can say it's just Twitter or Facebook or whatever, but social networking is a common way to organize these days. Have you seen and heard the things the Martin supporters are saying? Did you see the guy with the shirt that had a picture of Zimmerman in rifle crosshairs? Did you see the tweet from Victor Cruz that said the 'hood will take care of Zimmerman. The Black Panthers put a bounty on Zimmerman's head. Spike Lee tweeted his address (turned out to be wrong). What did he expect people to do with that information? Police were prepared for rioting in every major city. Why would they waste money and resources on this if they didn't take these threats seriously? Even with the show of police force, some "peaceful" protesters still broke business windows, vandalized cars, and started fires. Some protesters in California burned a California state flag (I don't know why they were so angry at the state of California for a case that was tried in Florida). Of course the right wing media freaks out more than normal people do when black people threaten violence, but I don't think all these threats should be ignored, and the police forces in major cities did the right thing by preparing for riots.
