Re: The Constitutional Crisis Thread
Two democratic senators asked the Office of the Inspector General in DHS to investigate the rollout of the executive order. https://www.scribd.com/document/3379273 ... te&irgwc=1 It looks like the OIG may be starting an investigation. One source claims that the OIG's office has put a "hold" on all documents related to the rollout. Hold means "preserve everything." https://theintercept.com/2017/02/01/hom ... servation/ The Intercept is a website that encourages and reports leaks. A "hold" would indicate the start of an investigation. Maybe we will learn some stuff.
ETA: The OIG did, indeed, announce this morning that an investigation is being conducted.
Update on the Aziz case.
Three motions are scheduled for hearing tomorrow:
(1) Motion to intervene filed by the Commonwealth of Virginia and a couple of individuals.
(2) Motion to show Cause. Virginia filed a motion to have the court order the government to prove it complied with the TRO.
(3) Joint Motion to Hold Petitioners Claims in Abeyance. This motion indicates that the government and the Azizes have reached some kind of settlement that will take a few days to implement. If the Aziz claims are settled, then the remaining claims will be by the two new individuals and Virginia.
Virginia filed a motion for a Preliminary Injunction. It asks the court to enter an injunction that prevents enforcement of section 3(c) of the executive order. That's the part that deals with entry of citizens from the seven countries.
The motion is scheduled for hearing on Friday, February 10.

I wonder if we're going to see results of the IG investigation online? Or is that going to be an FOIA issue? I'd love to see exactly what happened and how it happened.

Should be available online. https://www.oig.dhs.gov/assets/pr/2017/oigpr-020217.pdf The same basic information is being sought in the various lawsuit and in a FOIA request filed by the ACLU

Res Ipsa wrote:Another data point: With certain specified exceptions, all valid immigrant and nonimmigrant visas for citizens of the seven countries listed in the executive order have been revoked. I haven't had time to run down what the exceptions are and exactly what the ramifications are. But, if you are a citizen of one of the seven countries and you entered legally on a visa, your visa is gone.
How does any of this qualify as a data point?

Re: The Constitutional Crisis Thread
Here's an article from Slate claiming that TROs issued in Massachusetts and California are still being violated. http://www.slate.com/articles/news_and_ ... m_ban.html
Update on the Aziz case in Virginia: The motions to intervene by Virginia and a couple of individuals were granted. The show cause motion filed by Virginia was denied without prejudice (meaning it can be refiled in the future). The court did, however, order the government to produce some of the information requested in the Show Cause motion:
The court extended the TRO to next Friday.
The federal district court in Washington has apparently halted enforcement of Trump's Immigration executive order on a nationwide basis. Nothing entered in the court docket yet.

If there's going to be a constitutional crisis, this would be a good court to watch.
ETA: The judge in the Washington case was appointed by GWB.
ETA: The judge in Massachusettes declined to extend his TRO. I didn't see anything on the docket for today in the CA case.

Dr. Shades. Please stop combining my posts. I'm posting breaking news. When you combine them, it pushes them down the page.

Okay.
