Nope, but you still don't say how speaking Spanish is evidence one is not American or in the US illegally. Even close to a border they have to have probable cause. Other then at a border check point they cannot just go around stopping anyone they want.

So over by Quebec on the US side where one will here French fairly often, shouldn't that be evidence they are not American and in the US illegally. That is the essence of your argument. How does hearing a certain language fairly often in an area establish the person is doing nothing wrong?

How about speaking french over by the Mexican border. That would be rare to hear. How does that establish evidence the person is in the US illegally?
