The full autopsy report won't be available until the toxicology results are received.

A second autopsy could be performed by a doctor hired by the defense.

If there are two autopsies...both reports will be entered into evidence and used by both sides.

I understand, but according to Res Ipsa and EAllusion the "did not die of asphyxiation" or "died of a heart attack" part of the report should be irrelevant to a jury.

Edit: If the autopsy report has no direct evidence of homicide, then the prosecution wouldn't want the report to be presented to a jury. The prosecution would ask the judge to block it.

I'm not going to go back into the thread to pull out EA's exact statement in context.

Like I said, in order to meet the criteria for 3rd degree murder as RI posted it, it doesn't matter which thing he died of. It matters that he died by the actions of Ex-Officer Chauvin that meets the criteria.

He could also have stacked charges like I said. He could be charged with manslaughter AND 3rd degree murder. The prosecution can lob charges on as new evidence is acquired.

If EA and RI are addressing the same issue, they are saying it's irrelevant because it doesn't matter which thing he died of. It matters that the officer's actions meet the criteria.

The other officers could be charged as complicit. Be watching for that to happen.

I understand, but if there is no evidence of asphyxiation or strangulation, then prosecution only needs the videos and the witnesses. and a report of the moment he was declared dead.

It doesn't matter if there is evidence of asphyxiation or strangulation.

The final determination of the coroner could be:

Cause of death: undetermined.
Manner of death: homicide

Wrong question again. Try harder.

EAllusion said, "I could see it mattering to a jury. Not that it should"

So if it shouldn't matter to a jury, why would a judge allow it? It doesn't make sense, you can't have it both ways.
You only get three strikes. You’re out.

So prosecution only needs the videos and the witnesses, and a report of the moment he was declared dead to win in court.

Jersey Girl: I believe he was charged with both murder and manslaughter.
