It's not unusual for states to have unconstitutional laws on their books. When a law is held unconstitutional, the state will in many cases stop enforcing the law, but the legislature won't take the step of repealing it. A good example is the pre-Roe abortion laws that stayed on the books even though they were unconstitutional under Roe. Are these newly passed laws? Has any state tried to enforce them?
